Texas Law

Texas law requires all drivers to use “ordinary care.” Texas law requires drivers for common carriers, such as large trucks and buses, to use a “high degree of care.”  Failure to use “ordinary care,” or a “high degree of care” when applicable, is negligence.

Product Defect Law

Car, truck, and tire manufacturers are responsible for the safety of their products. If a defective tire, brake, or another defective part causes a truck or car accident, Texas law imposes product liability responsibility on the manufacturer of the defective product.  

A product may be defective in one of three ways – manufacture, design, or marketing. 

A “manufacturing defect” means that the product deviated in its construction or quality from its specifications or planned output in a manner that renders it unreasonably dangerous. An “unreasonably dangerous” product is one that is dangerous to an extent beyond that which would be contemplated by the ordinary user of the product, with the ordinary knowledge common to the community as to the product’s characteristics.

A “design defect” is a condition of the product that renders it unreasonably dangerous as designed, taking into consideration the utility of the product and the risk involved in its use. For a design defect to exist there must have been a safer alternative design.

A “marketing defect” with respect to the product means the failure to give adequate warnings of the product’s dangers that were known or by the application of reasonably developed human skill and foresight should have been known or failure to give adequate instructions to avoid such dangers, which failure rendered the product unreasonably dangerous as marketed.

Car Accident Causes

Car accidents are truck accidents are often caused by the failure of motorists to exercise caution or pay attention to the road as they drive. Speeding, tailgating, and other driving behaviors all increase the likelihood of accidents occurring. In addition, distracted drivers can cause crashes and wrecks when they change the radio station, talk on a cell phone, eat, or fail to pay attention to the road.

Scientific research by David Strayer and others is revealing the cell phones create “inattention blindness.”  Driving while talking on cell phones may present as much risk as driving while drunk or under the influence drugs.

Drunk driving wrecks are a risk for everyone.  Mundy & Singley even successfully represented a City of Austin police officer, who while on duty was struck by a drunk driver.

Faulty tires cause wrecks more frequently than many drivers know.  Tire dangers include tires that are older than six or seven years old.   Tire age code are molded into the tire itself.  The code is starts with “DOT” (the U.S. Department of Transportation) followed by a series of letters and numbers, which document the manufacturing plant location.  The code ends with four numbers such as “2501” which represents the week and year of manufacture.  “2501” would indicate the tire was manufactured in the 25th week of 2001.    Many safety experts believe tires should be replaced at six years of age, even if the tire otherwise appears to be in good condition.  “New” tires frequently may be several years old at the time they are purchased.  Check your tires for proper inflation, adequate tread, any unusual appearance such as cuts, and also check for tire age.  Tire condition is very important to your safety.

Truck Driving Regulations & Crash Prevention

Federal law imposes strict regulations for safe driving on truck drivers.  If a truck causes a wreck, violation of these regulations can constitute negligence.  

Driver fatigue is one of the most common causes of truck wrecks.  Truck drivers are required to have a minimum of 10 hours or more of off-duty time every day.  They are limited to a maximum of 14 hours of on-duty time.  A truck driver is allowed to drive a maximum of 11 hours during the 14 hours of on-duty time.    Federal law limits the on-duty time of a truck driver to a maximum of 60 hours in a 7 day period, or 70 hours in an 8 day period.  Then they are required to take 34 hours of rest time, before going on duty again.

Trucking companies are required to train their employees to comply with these regulations. When a trucking company fails to fulfill its responsibilities and a truck or car wreck results, the trucking company and the truck driver, or both, may be held legally responsible for the resulting injuries.

How Does Insurance Work?

Poorly is the most common feeling from everyone involved in a wreck.

Do not give a statement to the other driver’s insurance company until you have a lawyer to help you! 

The other driver’s insurance company is not your friend and it is not out to help you.  Their insurance company will have a very friendly person call you trying to coax you into giving a statement, usually within a few days of the wreck. Do not do it! The other driver’s insurance company has a duty is to protect the other driver, and a desire to protect its profits.   It has no obligation to help you.  If you are seriously injured, you will need your own lawyer to help you receive fair treatment.

Call your insurer as soon as you reasonably can to notify them of the wreck.   Your insurance company will pay for the property damage to your car, and provide a rental car, depending on whether you paid for this type of coverage.   Your insurance usually is only required to pay you the fair market value of your car.  If you have personal injury protection, also known as “PIP,” it helps cover your medical deductibles, co-pays, and similar out of pocket expenses.   If the other driver is claiming that you are at fault, your liability insurer will hire and pay for a lawyer to defend you.   Your insurance does not and will not hire a lawyer or anyone else to help make a claim against the other driver.  You are responsible for hiring a lawyer to represent you.

In the event you are seriously injured, if you wish to hold the other driver responsible, Texas law requires you to pursue a claim directly against the other driver, and their employer if they were driving on the job.   Their insurance company will then hire and pay for a lawyer to defend them.  Their insurance company will pay the amounts the other driver is obligated to pay to you.  In Texas, unlike some other states, you may not proceed directly against the other driver’s the insurance company.
